If mediation fails to resolve the dispute, any controversy or claim arising out of or relating to these Terms shall be settled by arbitration in accordance with the laws of Tanzania. The arbitration shall be conducted in Arusha, Tanzania, by a single arbitrator. The arbitrator's decision shall be final and binding, and judgment upon the award may be entered in any court having jurisdiction thereof.

8.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRE ARBITRATION CLAUSE SHALL BE NULL AND VOID.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Arusha, Tanzania. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
